All members using the services of EZVMGM are expected to consciously accept the terms and conditions as set out herein below. In addition, when you use or visit any current or future EZVMGM service or any business affiliated with EZVMGM, whether or not included in the EZVMGM Web site, you will also be subject to the guidelines and conditions applicable to such service or business.
EZVMGM considers all users availing services from EZVMGM to have read, understood and expressly accepted and agreed to the terms and conditions hereof and this agreement shall govern the relationship between you and EZVMGM and all transactions or services by, with or in connection with EZVMGM for all purposes, and shall be unconditionally binding between the parties without any reservation. All rights, privileges, obligations and liabilities of you and/or EZVMGM with respect to any transactions or services by, with or in connection with EZVMGM for all purposes shall be governed by this agreement. The terms and conditions may be modified and/or altered by EZVMGM from time to time at its sole discretion.

1.Criteria

EZVMGM believes that the information that may be submitted by you to be true and accurate even if the information is provided during the registration by your family, friends, relatives on your behalf under your express consent and EZVMGM shall be acting on the basis of it. EZVMGM does not claim the responsibility to verify the accuracy or genuineness of the information submitted by you.
We expect our members to be legally permitted to enter into a matrimonial relationship and the registration demands you to be of legal marriageable age as per the laws of India (currently 18 years or over for women and 21 years or over for men) and the maximum age limit is 70 years.
EzhavaMangalyam.com site is only to facilitate personal advertisement for lawful matrimonial alliance between persons who are legally competent to enter into matrimony under the laws to which they are subject. Membership in the Service is void where prohibited. By using this Site, you represent and warrant that you have the right, authority, and legal capacity to enter into this Agreement and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony. You also agree to abide by all of the terms and conditions of this Agreement.
If at any time EZVMGM is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation about your eligibility, EZVMGM reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your unutilized subscription fee.

2.Registration

EZVMGM insist you to complete the registration process with fairness and honesty while furnishing your personal information. An effective and efficient match making demands yourself furnishing true, accurate, current and complete information. You further undertake that you alone shall be responsible or liable for any information provided in this application form. In order to serve you better if EZVMGM requires additional details you agree to provide it.
Members are requested not to include key details of the profile in field other than the applicable field.
It is agreed that EZVMGM has of complete right to suspend or terminate your membership in case EZVMGM comes to know or has reasons to believe that any information provided by you for registration or otherwise is found to be untrue, inaccurate, or incomplete. Also in that case, EZVMGM can surrender the amount paid by you towards membership fee and refuse to service you thereafter.

3.Communications

• It is agreed hereby that you invite EZVMGM or its authorised personnel to communicate to you through any telecom resources in the registered number provided by you to explain, explicate and clarify the various services provided by EZVMGM and to assist, aid or support you in availing the said services of EZVMGM.

3.3  You are representing that you or the mobile number submitted by you is not registered with the Do Not Disturb / National Customer Preference Register and/or you have already changed your registration suitably.

Further and in any event, you do hereby also unconditionally agree and undertake that this invitation and solicitation shall supersede any preferences set by you with or registration done with the Do Not Disturb ("DND Register")/ National Customer Preference Register ("NCPR"). Without prejudice to the aforesaid and in any event, by expressly inviting and soliciting the services from EZVMGM, you also unconditionally agree that your rights under the Telecom Commercial Communications Customer Preference Regulations, 2010 or any subsequent amendments thereto or under NCPR, are kept in abeyance or remain extinguished till you expressly communicate for discontinuation of relationship.
3. 5. You also unconditionally agree to indemnify EZVMGM against all losses, damages, penalties, costs or consequences whether direct or indirect, that may arise out of any breach or violation of the aforesaid representation, commitment and undertaking.
3. 6. When you visit EZVMGM or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Members are supposed to have read and understood our Privacy Policy that governs your visit to EZVMGM, to understand our practices. EZVMGM has the right to change its features and services from time to time based on members’ comments or as a result of a change of policy in our company.

By registering your profile through any of our domains [Listed in the Annexure], you explicitly authorize EZVMGM to automatically copy your profiles from EZVMGM domain to its Community/ regional Bases Matrimonial Sites based on member information relevance like caste, sub caste, religion, age, marital status etc.

8. Your Account

EZVMGM members are expected to take some simple but important precautions to maintain the confidentiality of your account. They include keeping your login details undisclosed to anyone and restricting access to your computer. EZVMGM is not responsible for any activity that occurs under your account or password. It is agreed hereby that the information you provide in EZVMGM is available to all other users also and that EZVMGM neither has any control nor any responsibility or accountability if information is misused, exploited or abused by any third party.
You hereby agree not to engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk email to other EZVMGM Members. Although EZVMGM cannot monitor the conduct of its Members off the EzhavaMangalyam.com Site, it is also a violation of these rules to use any information obtained from other members in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.
Multiple profiles of the same person are not allowed on EZVMGM. Also EZVMGM reserves the right to deactivate all multiple profiles without any refund of subscription fees.
The Partner Preference should be set by every member. In case the member has not set the Preference or has not set the Preference correctly, then EZVMGM shall set the Partner Preference based on his/her profile information where member can also edit the same at any point of time.
In order to protect EZVMGM and/or our Members from any abuse / misuse, EZVMGM reserves the right to take appropriate steps as it deems appropriate in its sole discretion in order to protect interest of other Members.

You cannot use any automated processes, including IRC Bots, EXE's, CGI or any other programs/scripts to view content on or communicate / contact / respond / interact with EZVMGM and/or its members.
EZVMGM reserves the right to screen communications/advertisements that you may send to other Member(s) and also regulate the same by deleting unwarranted/obscene communications/advertisements at any time at its sole discretion without prior notice to any Member.
You may terminate your membership at any time, for any reason by writing to EZVMGM. In the event you terminate your membership, you will not be entitled to a refund of any unutilized subscription fees, if any, paid by you, except where otherwise stated in writing. EZVMGM may terminate your access to the Site and/or your membership for any reason effective upon sending notice to you at the email address as provided you in your application for membership or such other email address as you may later provided to EZVMGM. If EZVMGM terminates your membership for breach of terms of this Agreement, you will not be entitled to any refund of any unused Subscription fees, if any, paid by you. Certain provisions of this Agreement shall remain effective even on termination. Term for the paid Membership would be in accordance with the type of membership undertaken.
EZVMGM and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel subscription at their sole discretion.

9. Membership and Money back Guarantee

By registering your profile through any of our domains [Listed in the Annexure] or by the remittance of fees you become a member of EZVMGM.
Membership is not automatic: The right of admission vests with EZVMGM. You become a member upon due acceptance of the Profile/Payment by EZVMGM. Membership and rights of admission is reserved solely for Ezhava / Thiyya Community all over the world.

Length of Membership: You continue to be a member of EZVMGM till:
EZVMGM discharges its obligations to you by rendering its services to you; or EZVMGM or yourself terminate the membership arrangement.
Paid Memberships: Validity of your paid membership is based on days and not based on months.
Expiry of Membership - Once your membership with us expires, you will not be able to access your personalized messages sent, and mobile numbers viewed by you. We request you to save all your contacts you had contacted already and also upgrade your membership with us to enjoy access to these features.
Privacy of Membership: Your Membership is only for personal use. It is not to be assigned, transferred or licensed so as to be used by any other person/entity, without the express written consent of EZVMGM.
Members are advised to make appropriate/thorough enquiries before acting upon any matrimonial advertisement. EZVMGM does not provide guarantee for or assurance of or subscribe to the claims and representations made by advertisers regarding particulars of status, age, income of other members. EZVMGM also does not vouch for the contents of the Voice Messages exchanged between members.
EZVMGM reserves the right but is not obligated, to place Matrimonial Classifieds derived from your EZVMGM profile in newspapers, television or any other media at the sole discretion of EZVMGM. Members are advised to make appropriate/thorough enquiries before acting upon any response to these matrimonial advertisements. EZVMGM does not provide guarantee for or assurance of or subscribe to the claims and representations made by respondents regarding any particulars including but not limited to status, age, income.

10. Online Conduct

It is hereby agreed that you are responsible for the content and information [including profile and photograph] you post or transmit through EZVMGM's services. You understand and agree that EZVMGM may delete any listing, content, communication, photos or profiles (collectively, "Content") that in the sole judgment of EZVMGM violate this Agreement or which might be defamatory, blasphemous, abusive, obscene, sexually oriented, profane, intimidating, illegal, harm, or threaten the safety of either EZVMGM and/or its Members or in violation of the rights of any person, including intellectual property rights.
No content or information shall contain details or particulars of any of EZVMGM's competitors, including their contact details. You will not use either your online or offline membership as a platform for any kind of promotional campaign, solicitation, advertising or dealing in any products or services or transmit any chain letters or junk mails.

Content Posted on the Site: EZVMGM hereby alerts and warns its members of the possibility of unauthorized posting of contents by any person including members and unauthorized users and advises discretion in access since such content, information or representation may not be suitable to you including being offensive. EZVMGM will not in any way be responsible for such content, information or representations. EZVMGM is also not responsible for alterations, modifications, deletion, reproduction, sale, transmission or any such misuse of data and content in the public domain by any user.
With respect to Content you submit or make available for inclusion on publicly accessible areas of the Site including but not limited to your contact details, you hereby automatically grant, and you represent and warrant that you have the right to grant, to EZVMGM and other EZVMGM Members unconditionally and irrevocably the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Site and to EZVMGM members from time to time.
EZVMGM reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, EZVMGM may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence, EZVMGM may, in its sole discretion, terminate your Membership without a refund.
EZVMGM reserves the right to remove/edit any information posted by the member on the publicly accessible areas of the site which talks about social media related content.

There is a limit to the number of profiles you are allowed to contact each day. Also, you cannot contact more than 500 profiles in a period of 3 months.
Being a free member you can express your interest to a limited number of members. EZVMGM reserves the right to provide this feature to its members.

EZVMGM has the right to suspend your profile without any prior notice.

EZVMGM reserves the right to edit/delete your photo if it's not a valid/clear/related one.

If we find duplicate profiles then we have rights to suspend any of the profile or all the profiles.
EZVMGM reserves the right but is not obligated, to edit, delete, eclipse or withhold display of such content or information as it deems fit in the light of the rules prescribed above.

To enhance the security of its members, EZVMGM has restricted copying and saving images and content from certain sections of the portal.

We validate only the profile details of the member. Character verification has to be done by interested parties themselves.

• You must use the EZVMGM Service in a manner consistent with any and all applicable local, state, and federal laws, rules and regulations.
• You cannot include in your Member profile, visible to other members, any telephone numbers, street addresses, URL's, and email addresses.

The following is an indicative list of the kind of Content that is illegal or prohibited on the Site. EZVMGM will investigate and take appropriate legal action in its sole discretion against anyone who violates this Agreement, including without limitation, removing the offending communication / Content from the Service and terminating the Membership of such violators without a refund.
Illegal and prohibitive Content includes Content which:

1. is blatantly offensive to the community, such as Content that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual;
2. harasses or advocates harassment of another person;
3. involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
4. promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
5. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
6. contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;
7. displays pornographic or sexually explicit material of any kind;
8. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

EZVMGM may also modify the profile for other reasons not mentioned herewith. If any abusive content is found, EZVMGM has the right to suspend your profile.

11. Disclaimer of Warranties And Limitation of Liability

This site is provided by EZVMGM on an "as is" and "as available" basis. In no event will EZVMGM be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the EZVMGM Service, even if EZVMGM has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, EZVMGM's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to EZVMGM, for the Service during the term of membership. • Under no circumstances will EZVMGM be responsible for any loss or damage resulting from anyone's use of the Site or the Service and/or any Content posted on the EZVMGM Site or transmitted to EZVMGM Members.
• The exchange of matrimonial profile(s) through or by "EZVMGM" is not a matrimonial offer and/or recommendation from/by EZVMGM. EZVMGM shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, any relations (including but not limited to matrimonial relations) established pursuant to the use of EZVMGM.
• The Site and the Service are provided "AS-IS" and EZVMGM expressly disclaims any warranty of fitness for a particular purpose or non-infringement. EZVMGM cannot guarantee and does not promise any specific results from use of the Site and/or the EZVMGM Service.

• All liability, whether civil or criminal arising out of any Content that is Posted on the Site will be of that Member / user / third party who has Posted such Content and EZVMGM reserves its right to claim damages from such Member/ user / third party that it may suffer as a result of such Content Posted on the Site. EZVMGM does not claim ownership of Content you submit or make available for inclusion on the Service.

12. Refund Of Fee

If you choose to terminate your membership, the MEMBERSHIP FEES ARE NOT REFUNDABLE under any circumstances.

Your membership in the EZVMGM service is for your sole, personal use. You may not authorize others to use your membership and you may not assign or transfer your account to any other person or entity.

13. No Agency

Besides the provision of services, EZVMGM acts as a platform for all its members to interchange information that would promote their common matrimonial objectives. It is to be distinctly understood that EZVMGM will only provide contact between and among members within its service framework and not the direct contact details of such members. EZVMGM is not the agent of any member and does not partake in the interchange or the results thereof. EZVMGM reserves the right, but has no obligation, to monitor disputes between you and other members of EZVMGM.

14. Right to form Consortium/Associates

While providing services, EZVMGM may outsource any part thereof to any competent person or organization, with or without disclosing it to you. However, your membership rights and responsibilities continue as against EZVMGM only and not against such persons or organizations.

15. Indemnity

You hereby agree to indemnify, defend and hold harmless EZVMGM and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by EZVMGM and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to this agreement.
You shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and EZVMGM cannot be held responsible for the same.

16. General Provisions

Confidentiality: EZVMGM will maintain confidential, all personal information [other than that meant for posting or transmission] furnished by members and shall take all possible and /or bonafide steps for maintaining the confidentiality. However, EZVMGM may divulge such information if required by law. It is unconditionally agreed, understood and acknowledged by you that the information and/or data that may be submitted by you shall be preserved and retained by EZVMGM for all time to come as permissible under law, notwithstanding cessation, termination or discontinuation of the membership.
Termination of Membership: The membership may be terminated by either party by serving a written notice on the other. EZVMGM reserves the right to terminate the membership, to suspend a profile or to disable access in respect of any member in breach of any of the terms. In any case the Membership fees will not be refundable.
Site Policies, Modification and Severability

We reserve the right to make changes to our site, policies, and these Terms and Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

The membership is deemed to have been entered into at Chennai, India and the laws of India will govern the membership and any violation of the terms and conditions provided herein. Disputes arising out of or in any way affecting the membership including interpretation of any of the terms are subject to Courts of appropriate jurisdiction in Chennai. You hereby explicitly agree for Chennai courts’ jurisdiction for any disputes that may arise.
